Notice of Privacy Practices
Our responsibilities
We are required by law to protect the privacy of your health information, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information. We will not use or share your information other than as described here unless you tell us in writing that we can. If you give us written permission, you may change your mind at any time by letting us know in writing.
How we use and share your health information
- Treatment. We use your information to perform your ultrasound and share it with the providers involved in your care, including the provider who ordered your exam and the board-certified maternal-fetal medicine physicians who read your images and prepare your report.
- Payment. We use your information to bill and collect payment for our services and to prepare a superbill you may submit to your insurer.
- Health care operations. We use your information to run our practice, improve quality, train staff, and maintain accreditation, for example when the AIUM reviews sample cases.
- Business associates. We share information with companies that perform services for us, such as our scheduling and records system, our image reporting platform, and our fax service. They must sign agreements to protect your information.
- Appointment reminders. We may contact you by text, email, or phone about appointments, forms, and your care, using the preferences you give us.
Other ways we may use or share your information
We are allowed or required to share your information in certain situations, usually to contribute to the public good. We must meet many conditions in the law before we can share your information for these purposes:
- When required by federal, state, or local law
- For public health and safety activities, such as preventing disease, reporting adverse events, or reporting suspected abuse, neglect, or domestic violence
- To prevent or lessen a serious threat to anyone's health or safety
- For health oversight activities, such as audits, investigations, and licensure
- In response to a court or administrative order, or in response to a subpoena
- For law enforcement purposes or with a law enforcement official
- To coroners, medical examiners, or funeral directors
- For workers' compensation claims
- For special government functions, such as military, national security, and presidential protective services
- For research, when approved through a process that protects your privacy
Your choices
You have a right to tell us whether to share information with family, close friends, or others involved in your care. If you are not able to tell us your preference, for example if you are unconscious, we may share your information if we believe it is in your best interest. In these cases we never share your information unless you give us written permission: marketing purposes and sale of your information.
Your rights
- Get a copy of your health record. You can ask to see or get an electronic or paper copy of your records, including your ultrasound report. We will provide a copy, usually within 30 days of your request. We may charge a reasonable, cost-based fee.
- Ask us to correct your record. You can ask us to correct information you think is incorrect or incomplete. We may say no, but we will tell you why in writing within 60 days.
- Request confidential communications. You can ask us to contact you in a specific way (for example, a different phone number or address) or to send mail to a different address. We will say yes to all reasonable requests.
- Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment, or operations. We are not required to agree if it would affect your care. If you pay for a service in full out of pocket, you can ask us not to share that information with your health insurer, and we will say yes unless a law requires us to share it.
- Get a list of those with whom we have shared information. You can ask for a list (accounting) of the times we have shared your information for six years prior to the date you ask, who we shared it with, and why. This will not include disclosures for treatment, payment, and operations, and certain other disclosures. We will provide one list a year for free.
- Get a copy of this notice. You can ask for a paper copy of this notice at any time, even if you agreed to receive it electronically.
- Choose someone to act for you. If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
- File a complaint. If you feel we have violated your rights, you can contact our Privacy Officer below. You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or online at the HHS website. We will not retaliate against you for filing a complaint.
Changes to this notice
We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and in your patient portal.
